1. Scope

These General Terms and Conditions (hereinafter "GTC") apply to all services provided by STP Professional Co., Ltd. (hereinafter "STP Professional Co., Ltd.", "we" or "us") through the website thailandauswandern.com/ltr and the associated document portal.

By booking our LTR Visa Full-Service, you accept these GTC. Please read them carefully before making a booking.

3. Description of Services

3.1 LTR Visa Full-Service

Our LTR Visa Full-Service includes:

  • Consultation: Individual initial consultation to determine qualification for an LTR visa category and preparation of a personalised roadmap.
  • Document preparation: Creation of a personalised document checklist, review of submitted documents for completeness and accuracy, feedback on missing or insufficient documents.
  • Application submission: Submission of the LTR visa application through the official online portal of the Board of Investment (BOI) on behalf of the client, including communication with the BOI and relevant authorities.
  • Accompaniment: Personal accompaniment of the client to the visa handover at the Thailand Investment and Expat Services Center (TIESC) in Bangkok.
  • Aftercare: Support for 12 months after visa issuance with questions regarding annual reporting, passport changes and other LTR-related matters.

3.2 Not Included in the Scope of Services

The following services are not included in the LTR Visa Full-Service:

  • The government fee for the LTR Visa (currently 50,000 THB per person, payable at visa handover)
  • Travel and accommodation costs for visa handover in Bangkok
  • Costs for obtaining documents in the home country (e.g. apostilles, certified translations, police clearance certificates)
  • Costs for health insurance
  • Additional services (tax advice, real estate advice, legal advice, etc.)

4. No Guarantee of Success

Important notice: STP Professional Co., Ltd. provides a professional consulting and application service. The approval or rejection of the LTR Visa lies solely at the discretion of the Board of Investment (BOI) and the Thai authorities. STP Professional Co., Ltd. cannot guarantee a successful visa issuance.

Our service consists of the best possible preparation and submission of your application as well as professional communication with the authorities. The final decision on visa issuance rests with the Thai authorities and is binding on STP Professional Co., Ltd.

5. Client Obligations

5.1 Truthful Information

The client undertakes to provide all information truthfully and completely. This applies in particular to:

  • Personal data (name, date of birth, nationality)
  • Income and financial circumstances
  • Existing visa history and entry/exit dates
  • Investments in Thailand
  • Criminal convictions or pending proceedings

False information may lead to immediate termination of the contract without refund and may have criminal consequences.

5.2 Duty to Cooperate

The client is obliged to:

  • Provide all requested documents within reasonable deadlines
  • Respond promptly to enquiries from STP Professional Co., Ltd. and the authorities (within 5 working days, unless otherwise agreed)
  • Attend the initial consultation and all agreed appointments
  • Inform STP Professional Co., Ltd. immediately of any changes in personal circumstances (e.g. change of income, loss of health insurance, new criminal convictions)

5.3 Authenticity of Documents

The client warrants that all submitted documents are genuine, unaltered and valid. The submission of forged documents constitutes a serious breach of contract and may be prosecuted under Thai law.

6. Prices and Payment

6.1 Service Fee

The current service fee for the LTR Visa Full-Service is 65,000 THB (sixty-five thousand Thai Baht). The price is inclusive of 7% Thai value added tax (VAT).

6.2 Payment Terms

The service fee is payable by bank transfer in 3 instalments (total: 65,000 THB):

  • Document review: 15,000 THB
  • Upon submission to Immigration: 25,000 THB
  • Upon appointment confirmation for LTR visa receipt: 25,000 THB

Payment is made exclusively by bank transfer to the STP Professional Co., Ltd. business account.

6.3 Due Date

The service fee is due immediately upon booking. The provision of services commences upon receipt of payment.

7. Right of Withdrawal and Refund

7.1 Right of Withdrawal

The client has the right to withdraw from the contract during the document review phase. However, the document review fee will not be refunded if the review of documents has already commenced.

7.2 Refund After Commencement of Services

Once the service has commenced after submission of the application, the following conditions apply: In the event that the applicant does not meet the requirements set by the relevant authorities — such as the Board of Investment (BOI), the Immigration Bureau, the Ministry of Foreign Affairs, embassies or other relevant bodies — the company will refund only a portion of the fee for the first phase of the visa application process in the amount of 10,000 THB.

7.3 Refund in Case of Rejection by Authorities

In the event of rejection of the application by the BOI, the Thai Immigration Bureau or any other competent authority, no refund claim exists, as the service has already been rendered. STP Professional Co., Ltd. will, however, offer the client a free analysis of the reasons for rejection as well as advice on possible next steps.

7.4 No Refund of Government Fee

The government fee for the LTR visa in the amount of 50,000 THB is paid directly by the client to the Thai authorities and is non-refundable under any circumstances.

8. Liability

8.1 Limitation of Liability

STP Professional Co., Ltd. is liable for intentional misconduct and gross negligence in accordance with statutory provisions. For slight negligence, STP Professional Co., Ltd. is liable only in the event of a breach of material contractual obligations (cardinal obligations), limited to the foreseeable, contract-typical damage.

8.2 Exclusion of Liability

STP Professional Co., Ltd. shall not be liable for:

  • Decisions of the Thai authorities, in particular the rejection of the LTR visa application
  • Delays in the official review process
  • Changes to the legal framework or LTR visa requirements by the Thai government
  • Damage caused by false or incomplete information provided by the client
  • Damage caused by the client's delayed provision of documents
  • Exchange rate fluctuations
  • Technical disruptions at third-party providers (cloud service, banking systems)

8.3 Maximum Liability

The total liability of STP Professional Co., Ltd. is in any case limited to the amount of the service fee paid by the client.

9. Confidentiality

9.1 Confidentiality

STP Professional Co., Ltd. treats all information and documents provided by the client as strictly confidential. Disclosure to third parties is made only:

  • To the Thai authorities responsible for the LTR application
  • To service providers engaged by STP Professional Co., Ltd. (e.g. cloud storage, payment processing) that are contractually bound to confidentiality
  • Where there is a statutory obligation to disclose

9.2 Advertising-Free Communication

STP Professional Co., Ltd. uses the client's contact details exclusively for communication in connection with the booked service. Promotional communication is sent only with the express consent of the client.

10. Term and Termination

11.1 Commencement of Contract

The contract is concluded upon successful payment of the service fee.

11.2 End of Contract

The contract ends automatically:

  • 12 months after successful visa issuance (end of the aftercare period)
  • Upon rejection of the LTR application by the BOI, after completion of the analysis and advice on next steps

11.3 Extraordinary Termination

STP Professional Co., Ltd. is entitled to extraordinary termination if:

  • The client has provided false information
  • The client has submitted forged documents
  • The client fails to meet their duty to cooperate despite two reminders
  • The client demonstrably no longer meets the LTR visa requirements

In the event of extraordinary termination by STP Professional Co., Ltd. due to false statements or forged documents, no refund claim exists.

11. Dispute Resolution

11.1 Applicable Law

The law of the Kingdom of Thailand shall apply.

11.2 Jurisdiction

The place of jurisdiction for all disputes arising from or in connection with this contract is Prachuap Khiri Khan, Thailand.

11.3 Amicable Settlement

Before initiating legal proceedings, both parties undertake to seek an amicable settlement. Complaints may be directed to info@swissthaipro.ch and will be processed within 14 working days.

12. Final Provisions

12.1 Severability Clause

Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that most closely approximates the economic purpose of the invalid provision.

12.2 Written Form

Amendments and supplements to these GTC require written form. This also applies to the waiver of this written form requirement.

12.3 Assignment

The client may not assign their rights and obligations under this contract to third parties without the written consent of STP Professional Co., Ltd.

12.4 Language

These GTC are drafted in the German language. In the event of a translation into other languages, the German version shall prevail.
